– I’m all for this, BUT…they are going to say that he was not ‘convicted’ yet for being in the Insurrection.

– No conviction but still punished got it… guilty until proven innocent is the new norm.

– If they can read, SCOTUS must rule likewise. May democracy save itself. And the world.

– Um, is that legal for them to do that? I mean, is there a legal frame work to say that even if he is 100% guilty of it. Is it really legal to remove him as a candidate?

Is there a legal definition for “insurrection” as it applies to the 14th amendment, or is it just a word that can be thrown around like sedition used to be with the Sedition and Treason Act of 1918?

I haven’t been following this as much as I would like to have, but I’m really curious what the legal definition of insurrection is in this context.

The lower court ruling was simply a test balloon to see who would react and to what part of the ruling. Insurrection was confirmed but a president was immune apparently did not fly. If the insurrection was confirmed and the president is not immune from responsibility, the logical next step is prosecution.

Please explain this: if he’s not on the Colorado primary ballot, does that mean he’s also not on the Colorado ballot if he still wins the GOP nomination? Then, if he wins the presidential election without those 10 electoral votes, Colorado doesn’t recognize him as President? Swing states Ohio and Penn doing the same would be nice, but I’m not holding my breath.

I”m not a Trump fan,. but I have to ask. Was Trump charged and/or convicted of insurrection? I don’t think he was. I’m a bit concerned that a Colorado court has become prosecutor, judge and jury and declared the essence of a conviction when there have been no charges of insurrection filed.

The Supreme Court has to rule on this before Jan 5th (I think) for Trump to be able to be on ANY ballot. There is a law that says something about the nominees have to be submitted by then. Just because I call you a racist does not mean that you are a racist. Innocent until proven guilty. If no insurrection, then no 14th Amendment.

I don’t want judges to decide who I can vote for and it sounds like a 3rd world dictatorship decision to me. “Here’s who you guys can vote for? I don’t want America to turn into a world like that. As far as Trump goes, he’s never been charged in a court of law for an insurrection so how can he be penalized for an insurrection? I just wish fbi, cia, Russia, China, news media and anybody else would stay out of the election process and let the American people vote for their next president.

I have a problem with this ruling. Colorado is ruling that Trump engaged in insurrection, but I don’t recall Trump ever being tried in that state. He is currently awaiting trial in federal court on insurrection charges and until convicted, I don’t see how the Colorado ruling has any real impact. I believe the similar motions in Arizona, Michigan and Minnesota were rejected for this very reason. Let the federal court do its job. If he’s convicted (and I believe he will be), he will then be barred from every ballot in the country. Then we can celebrate for real.

Sorry, I don’t mean to rain on anyone’s parade. I just don’t see how getting pulled from the ballot in a state he’d never win anyway changes anything.

This is a violation of the freedom of speech. Some of us actually want to vote for him in protest to Biden. I don’t see how this will stand. I pay taxes and will vote for him again even if I have to write him in.
